Terms of Service

1. Acceptance of Terms

By accessing or using the Material Lift Supply website (materialliftsupply.com) or placing an order, you agree to be bound by these Terms of Service. If you do not agree, you may not use this site or purchase from us.

2. B2B Sales Only

Material Lift Supply sells exclusively to businesses, contractors, and organizations. By placing an order, you confirm that you are purchasing for commercial, industrial, or professional use and not for personal or household purposes.

3. Pricing & Payment

All prices are listed in USD and are subject to change without notice. We accept major credit cards, ACH/wire transfer, and Purchase Orders (Net 30 terms for approved accounts). Approved Net 30 accounts require a completed credit application. Material Lift Supply reserves the right to require prepayment on any order.

4. Order Confirmation & Fulfillment

An order is not confirmed until you receive a written order acknowledgment from Material Lift Supply. We reserve the right to cancel any order due to pricing errors, inventory unavailability, or suspected fraud. For high-ticket equipment, a member of our team may contact you to verify delivery requirements before releasing the order for shipment.

5. Freight Liability Clause

Material Lift Supply ships all equipment F.O.B. (Free on Board) Factory. Risk of loss and title transfer to the customer upon carrier pickup at the manufacturer's facility.

Material Lift Supply is not responsible for additional carrier charges resulting from inaccurate delivery information provided by the customer. This includes — but is not limited to — liftgate fees, residential delivery fees, redelivery fees, and storage fees.

Any undelivered or refused shipments due to lack of offloading equipment at the delivery site, missed delivery appointments, or inaccessible locations will incur redelivery or storage fees at the customer's expense.

Customers are required to inspect all shipments for damage before signing the Bill of Lading. Signing the BOL without noting damage releases the carrier from liability. Material Lift Supply must be notified within 48 hours of delivery for concealed damage claims.

6. Returns & Cancellations

Due to the size, weight, and custom nature of industrial equipment, all sales are final unless otherwise agreed in writing. Return requests must be submitted within 30 days of delivery. Approved returns are subject to a restocking fee of up to 25% and the customer is responsible for all return freight costs. Equipment must be returned in original, unused condition with all original packaging. Custom, made-to-order, or drop-shipped items may not be returnable.

7. Warranty

Material Lift Supply facilitates the administration of manufacturer warranties for all products sold. Please note that all warranty repairs, parts, and labor are governed strictly by the terms of the Original Equipment Manufacturer (OEM). Material Lift Supply does not provide an independent warranty of merchantability or fitness for a particular purpose.

Warranty claims must be directed through Material Lift Supply — do not contact the manufacturer directly. We will act as your warranty advocate, coordinating with the manufacturer's warranty department and authorized service network on your behalf.

8. Limitation of Liability

To the maximum extent permitted by law, Material Lift Supply and its parent company K and 2 Holdings LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our products or services. Our total liability shall not exceed the purchase price of the product in question.

9. Minimum Advertised Price (MAP) Policy

Material Lift Supply complies with all supplier Minimum Advertised Price (MAP) policies. We will never advertise, list, or sell any product below a supplier's established MAP. Violations of MAP policy by any party should be reported to sales@materialliftsupply.com.

We do not list, market, or sell any supplier's products, logos, or branded materials without a fully executed authorized distributor agreement.

10. Intellectual Property

All content on this website — including text, images, logos, and design — is the property of Material Lift Supply / K and 2 Holdings LLC or its licensors. You may not reproduce, distribute, or use any content without written permission.

11. Governing Law

These Terms of Service are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.
